Case of alleged menacing message adjourned

An allegation under the Computer Misuse Act has landed a 49-year-old construction supervisor in trouble with the law.

It is alleged that Derrick Nathaniel Brathwaite, of Storey Gap, Codrington Hill, St Michael contravened Section 2 Clause (a) of the Act when he unlawfully used a cellular phone to send an electronic message to Rhonda Brathwaite on July 29 which was menacing in character and intended to cause or was reckless as to whether he caused annoyance, inconvenience, distress or anxiety to the women to whom he intended the message to be communicated.

The alleged message read, “. . . the reason I ain’t in Barbados all now cause the Prime Minister of this country cause the planes not to stop, not to land. I tell you, I don’t care if you listen to this or don’t listen to it, when I come back to Barbados within the next week or two as long as the flight is clear, I don’t know whenever it is, I coming home. I want you and Ashley out of my house, I want you and Ashley out of my house. Carry long every single thing and leave my house please or not I gine jail. . . I know I ga gain jail when I come back Barbados, I know that for a fact. Please Rhonda and Ashley leave my house . . . leave my house, I beg y’all please.”

The accused pleaded not guilty to the charge before Magistrate Kristie Cuffy-Sargeant today and secured bail in the sum of $5 000 with one surety.

He has also been warned to stay away from the persons mentioned in the case. The matter is expected to continue in the No. 2 District ‘A’ Magistrates’ Court on February 17, 2021.
