A 40-year-old man, accused of raping a 13-year-old girl, has been remanded to HMP Dodds until December 4.
It is alleged that Troy Oneal Wiltshire, of Upper Wavell Avenue, Black Rock, St Michael, had sexual intercourse with the child without her consent on October 17, as well as sometime between April 1 and September 30.
Wiltshire, who is represented by attorney-at-law Safiya Moore, was not required to plead to the indictable charges when he appeared before Magistrate Kristie Cuffy-Sargeant today.
Based on the serious nature of the offence, the prosecutor objected to bail, saying it allegedly occurred “in a place of trust” as Wiltshire was the boyfriend of the child’s aunt and as such “betrayed that trust”.
The Crown also submitted that the alleged victim was of “tender school age” and was fearful of the accused; therefore she must be protected, as well as society in general.
It was also revealed that the accused man was already on bail for another matter when he allegedly committed the offence and that he had also failed, on two occasions, to meet the stipulation that he must report to the Black Rock Police Station every Monday and Thursday.
However, his attorney contended that the matters before the court were bailable and that her client was a fit and proper candidate to be considered for release. Moore also argued that the complainant did not live in the same household as Wiltshire and as such the court could impose conditions.
“He can be told to stay away 100 yards from the virtual complainant,” the lawyer argued, pointing out that her client was maintaining his innocence in the matter.
Moore also challenged the prosecution’s suggestion that society needed protection from Wiltshire, arguing that both offences were alleged to involved one complainant and not several in different jurisdictions.
Moore also submitted that her client was good for bail as he had not missed a court date in the last two years.
However, her application was denied and Wiltshire was remanded to the St Philip penal institution for the next 28 days.
