Wiltshire awaiting his fate after guilty plea

A St Michael man convicted of multiple traffic charges is on remand at Dodds pending sentencing next month.

Troy Oneal Wiltshire, of Upper Wavell Avenue, Black Rock pleaded guilty to eight offences during his appearance in the District ‘D’ Magistrates’ Court today.

The charges are failing to provide his driver’s licence or any form of government-issued identification along Bibby’s Lane when asked to do so by police; driving motor car M9660 when it was not insured or registered with the Licensing Authority; fraudulently using the number plates M9660 along the same road; failing to draw his vehicle as close as possible to the left side of the road and stopping at the approach of a police vehicle sounding a siren; driving in a manner dangerous to the public along Applewhaite Road; failing to comply with a Give Way traffic sign on Groves Main Road and a Stop sign on Applewhaite Road as well as driving when he was not the holder of a driver’s licence.

The 42-year-old, who has no previous traffic convictions but is known to the court, racked up the charges on May 27 around 12:43 p.m.

According to the summary of facts read by Sergeant Theodore McClean, police were providing backup to a colleague who was shot at Henly when motor car M9660 drove away from the area. Lawmen pursued, resulting in the traffic offences.

Wiltshire was also charged with contravening Paragraph (21) of the Emergency Management (Covid-19) Curfew (No.3) Directive when he was outdoors at Bibby’s Lane around 12:43 p.m. without a reasonable explanation.

He was further charged with assaulting and resisting Police Constable Jare Alleyne as well as assaulting Station Sergeant (ag) Mitchell Roach and Police Constable Ramond Welch as they executed their duties on the same date.

Wiltshire pleaded not guilty on those offences, and the prosecutor objected to bail based on the seriousness of the charges, the fact that police are looking for another man who was with the accused at the time; fears that he would interfere with the investigation and other witnesses if granted bail and the need to protect society.

But attorney-at-law Angela Mitchell-Gittens argued that her client was not charged in connection with any shooting.

She then provided an “explanation and not an excuse” to Chief Magistrate Ian Weekes regarding the traffic offences.

The defence attorney said she had been instructed that given the Covid-19 situation in the country and the lack of work Wiltshire had gone to St John for coconuts. She said he had stopped initially when police pursued him. However, when he saw several police officers approaching with guns he “panicked” and drove off.

Mitchell-Gittens said her client had taken full responsibility for all the traffic matters. “He took a foolish chance which resulted in . . . multiple traffic charges.”

She then put in an application for bail saying her client was a proper candidate despite the objections put forward by Sergeant McClean.

Her client, she revealed, had been in police custody for the better part of a week and police had yet to find the other suspect.

“So I am a little confused as to why they are looking for somebody else . . . He is charged with resisting and assaulting police. . . not burglary or anything”.

In making his decision Chief Magistrate Weekes stated that the traffic offences were “grave” as the accused is charged with dangerous driving and driving without insurance among other offences.

He ruled that Wiltshire be remanded until July 2.
