Court Report ordered on granny Barbados Today20/03/20191115 views Bridgetown Magistrate Kristie Cuffy-Sargeant wants to know more about the 65-year-old grandmother who pleaded guilty today to assaulting her 12-year-old girl granddaughter and exposing her to possible injury before imposing a sentence. The girl was seen in a video bound with rope and being dragged up stairs. Magdalene Anetha Agard, of Jemmotts, Durham, St Lucy, appeared in the District ‘A’ Magistrates’ Court along with two Christ Church women – 60-year-old Kim Bridgette Christabel Thompson, of Maxwell Coast Road and 77-year-old Bishop, Anne Rose of Roumaika House, Dayrells Road who are also charged with assault. The latter two pleaded not guilty to committing the offence on March 10, 2019. Magdalene Anetha Agard, Kim Bridgette Christabel Thompson and Anne Rose Thompson and Rose were given a September 4, 2019 date to return to the court and were warned to stay away from the child. Attorney-at-law Wallace Blackman mitigated on behalf of Agard – a first time offender. He told the court Agard was gainfully employed and had provided for her two adult children and grand children over the years. The lawyer said she has also assisted financially and otherwise in the rearing of the grandchildren. “She co-operated with police and has pleaded guilty on the first day before the court. The accused is very sorry for her actions in this matter and has acknowledged her wrongdoings. She is a very respected member of her community and I suggest that a bond to keep the peace could be looked at as an appropriate sentence in this case. I have also been instructed that the Child Care Board has been involved in the matter and the process is ongoing,” Blackman submitted. Magistrate Cuffy-Cargeant however told the defence attorney that the court must be careful when considering a sentence for the offence. She said the court cannot only make reference to the legislation governing the offence but must also pay attention to the person affected in the circumstances. “What is before the court is The Prevention of Cruelty to Children Act. A minor was affected by the accused’s actions, so we must also be very careful when we also say the accused is a first time offender,” Cuffy-Sargeant stated just before she ordered a pre-sentencing report on Agard. The accused grandmother will reappear before the court on May 29, 2019. She along with Rose and Thompson are on $3,000 bail in the meantime.
