Delay in case against DPP and AG

The hearing of the lawsuit brought against the State by former murder accused Frank Errol Gibson has been adjourned until next month.

When the matter came up today before Madam Justice Pamela Beckles, in the No. 5 Supreme Court, Crown Counsel Jared Richards from the Solicitor General’s Office requested
the adjournment.

However, Gibson’s lead attorney Larry Smith Q.C., who appears with counsel Ajamu Boardi and Jamiela Smith strongly opposed the adjournment and asked for damages
for the claimant. That matter will be heard tomorrow at 3 p.m.

Meantime the substantive case was adjourned to continue on December 3 and 14.

Gibson is claiming damages in excess of $2 million in his lawsuit against the office of the Director of Public Prosecutions and the Attorney General, as well as Dr Victor Eastmond, a principal witness in the murder case.

He has alleged that he was wrongfully charged, imprisoned and prosecuted for the murder of Francine Bolden at Pot House, St John which occurred between January 15 and 16, 2002.

After Gibson was charged and placed on remand for the crime, the then DPP Charles Leacock, Q.C. discontinued the case on November 8, 2012 on the grounds that there
was insufficient evidence to make out a case beyond reasonable doubt.
