Cumberbatch had previously pleaded guilty to having sexual intercourse with a girl under the age of 14 on November 20, 2013. The complainant was expected to be in court on Friday but was a no-show. Her mother, who was present, told the court she thought it better for her daughter not to come as she was still traumatized by the incident. She said the last time her daughter attended court she went into a state of depression. Upon hearing that, prosecutor Crown Counsel Romario Straker told Justice Smith-Bovell that he wanted to “amplify his sentencing submissions” on the next occasion. Cumberbatch is represented by Alvin Babb. Justice Smith-Bovell then adjourned the hearing until December 6, 2021, when Cumberbatch will be sentenced.
