Burke warned: Stay away from alcohol and victim

An incident which occurred while a 49-year-old man “had drinks” in his system landed him in trouble with the law.

Now, Henderson O’neale Burke, of Wotton Plantation, Christ Church has to find $1,500 in two months to pay the District ‘A’ Traffic Court. If he is unable to settle the fine during that time he will spend five months in prison for unlawfully and maliciously wounding Algernon Daniel on March 14.

Sergeant Edwin Pinder told Magistrate Graveney Bannister that the two men were involved in an argument along Dover Main Road after Burke used insulting language towards Daniel who was washing a car. However, as Daniel began to walk away from Burke, the accused struck him in the head and chest with a piece of PVC pipe, injuring him.

Daniel sustained a laceration to the head and in an effort to escape took up a stone and threw it at Burke.

The matter was reported to police and  Daniel was taken for medical attention and later discharged.

“He had in his drinks . . . both of us had in drinks,” said Burke who is known to the law courts.

The magistrate advised: “See the liquor and leave it alone.”

Burke has been ordered to stay away from Daniel who is expected to be warned to appear in court when the matter is called again on July 31.

The convicted man is on $2,500 bail in the meantime.
