Appeal court review of killer brothers’ sentences moves to 2022

The Director of Public Prosecutions’ case for a review of the sentences imposed on two convicted killers is now set for hearing on February 2 next year by the Court of Appeal.

But on that date, the panel of judges of Chief Justice Sir Patterson Cheltenham, Justices of Appeal Rajendra Narine and Francine Belle will also hear from the attorneys of brothers Stuart Kenny MacMillian Harewood and Scott Colby Richardson Harewood who have also filed an appeal against their sentence.

That’s because the Court of Appeal has consolidated the matters.

DPP Donna Babb-Agard QC along with Principal Crown Counsel Krystal Delaney are seeking a review of the brothers’ case under section 36B of the Criminal Appeal Act against the convicted duo.

Justice Pamela Beckles sentenced Stuart to 35 years in prison and his brother Scott to 38 years behind bars back in March for the 2014 “cold-blooded” killing of Derek Hunte.

Given the time that the two have already spent on remand and their guilty pleas, Stuart had 6,068 days or just over 16 years remaining to serve on his sentence. His younger brother had 7,247 days or just over 19 years to spend at Her Majesty’s Prison Dodds.

The two brothers, from Bequest, St Philip, had pleaded guilty to non-capital murder for Hunte’s shooting death on June 3, 2014.

In the cases now before the appeal court, attorneys-at-law Michael Lashley Q.C., Sade Harris, Simon Clarke and Dr Lenda Blackman are representing Stewart while Safiya Moore is Scott’s legal counsel.
