Man already on a gun charge, placed on remand for alleged theft

A 29-year-old man accused of stealing a $2800 chain and causing serious bodily harm had his request for bail denied on Monday when he appeared before Chief Magistrate Ian Weekes.

Weekes agreed with the prosecution’s position that bail should not be granted, in spite of the efforts of the defence attorney Kristin Vanderpool to secure the freedom of his client Shimar Romario Daisley of Odessa McClean Drive, St Michael.

Prosecutor Rudolph Boyce, objected to granting bail for Daisley who is accused of stealing a chain worth $2800 from Damien Agard and causing serious bodily harm to him with the intent to maim, disfigure or disable him on January 28, 2024.

Boyce indicated to the court that Daisley was already on bail on a firearm and ammunition matter. There was also concern that since the complainant in the matter was Daisley’s uncle, there was the possibility of interference with witnesses. The prosecutor said there was a need to protect the complainant who had sustained serious injuries.

Attorney-at-law Vanderpool argued that there have been no incidents since January 28, the date of the alleged offences. He also pointed out to the court that the law allows for bail to be granted even if the person is already on bail, in circumstances when the charge is of a different nature. The lawyer stated that his client had followed all bail conditions and was willing to comply with any others.

“He is not a threat and there is no evidence he will abscond,” Vanderpool added.

The Chief Magistrate sitting in the District ‘A’ Traffic Court, however, acknowledged the severity of the existing firearm and ammunition charge and remanded Daisley until August 12.
